1. Acceptance of Terms

By accessing or using RockStock ("App," "Service," or "Platform"), you agree to be bound by these Terms of Use ("Terms"), our End User License Agreement, and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Windmill AI ("Company," "we," "us," or "our"). You must be at least 18 years old to use this Service.

2. Description of Service

RockStock is a mobile application that provides:

• AI-powered stock analysis and insights
• Real-time and historical stock market data
• Customizable stock watchlists
• Financial news aggregation and AI-powered analysis
• Interactive AI chat for investment-related questions

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for safeguarding your account credentials. We recommend using a strong, unique password and enabling any available security features. We are not liable for any loss or damage arising from your failure to protect your account.

4. Subscription Plans and Payments

4.1 Free and Premium Tiers

RockStock offers both free and premium subscription tiers:

• Free Tier: Limited access to AI questions, news analysis, and watchlists
• Premium Tier: Unlimited AI conversations, unlimited news analysis, and unlimited customizable stock lists

4.2 Billing and Renewal

Premium subscriptions are billed through the Apple App Store. By subscribing:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

4.3 Refunds

All purchases are processed through the Apple App Store and are subject to Apple's refund policies. We do not process refunds directly. For refund requests, please contact Apple Support.

5. Acceptable Use Policy

You agree to use RockStock only for lawful purposes. You shall NOT:

• Use the Service for any illegal or unauthorized purpose
• Attempt to manipulate or deceive our AI systems
• Share false or misleading information
• Harass, abuse, or harm other users
• Attempt to access other users' accounts
• Use automated systems, bots, or scrapers to access the Service
• Circumvent any rate limits or usage restrictions
• Reproduce, distribute, or sell any part of the Service
• Use the Service to develop competing products
• Introduce viruses, malware, or other harmful code

6. AI-Generated Content

6.1 Nature of AI Content

RockStock utilizes artificial intelligence to generate analysis, insights, and responses. You acknowledge that:

• AI-generated content may not always be accurate, complete, or up-to-date
• AI responses are based on available data and algorithms, which have limitations
• The AI does not have real-time access to all market information
• AI-generated content should not replace professional financial advice

6.2 No Fiduciary Relationship

Your use of RockStock does not create a fiduciary, investment advisory, or professional relationship between you and Windmill AI. We are not responsible for any investment decisions you make based on information obtained through the App.

7. Third-Party Data and Services

RockStock may incorporate data from third-party sources including stock exchanges, financial data providers, and news outlets. We do not guarantee the accuracy or timeliness of third-party data. Third-party content is subject to the respective providers' terms and conditions.

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content, features, and functionality of RockStock, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the underlying code, are the exclusive property of Windmill AI and are protected by intellectual property laws.

8.2 Trademarks

"RockStock," "Windmill AI," and associated logos are trademarks of Windmill AI. You may not use our trademarks without prior written permission.

8.3 User Content

You retain ownership of content you create or submit. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for providing and improving the Service.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using RockStock, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE SERVICE
• RESULTS FROM USE OF THE SERVICE
• SECURITY OF DATA TRANSMISSION

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINDMILL AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• ANY INVESTMENT LOSSES OR FINANCIAL DAMAGES
• DAMAGES EXCEEDING THE AMOUNT PAID BY YOU IN THE PAST TWELVE MONTHS

12. Indemnification

You agree to indemnify, defend, and hold harmless Windmill AI and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your investment decisions based on information from the App

13. Termination

We may suspend or terminate your access to RockStock at any time, with or without cause or notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and associated data
• Provisions that should survive termination will remain in effect

You may terminate your account at any time by deleting your account through the App settings.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the App or via email. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

16. General Provisions

16.1 Entire Agreement

These Terms, along with our EULA and Privacy Policy, constitute the entire agreement between you and Windmill AI regarding the Service.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

16.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
